OVERVIEW OF DWI/DUI LEGAL PROCESS IN NEBRASKA
1. DWI/DUI. The drunk driving (dwi/dui) laws in Nebraska are both criminal and administrative.
Drunk driving arrests can result in either misdemeanor or felony charges in court. Drunk
driving arrests are also subject to administrative proceedings before the Department of
Motor Vehicles. With respect to the DMV administrative proceedings, your license will
be taken from you for the statutory time and you will have nothing to say about it unless
you timely file a petition for an administrative hearing with the dmv. You should
contact
an attorney immediately after your arrest so that a petition can be timely filed so that you
do not forfeit your right to a hearing.
Drunk driving charges can result in jail, license revocation, fines, costs, a requirement
that your auto insurance be verified to the DMV for a period of time, loss of employment,
and either an increase in your insurance premiums or cancellation of your insurance in
which event you would likely have to go to a high risk insurer.
The Nebraska statutes, and the case law arising out of individual cases, obviously cannot

2. FEES AND COSTS. These cases are handled on an hourly basis, plus costs. After
speaking with the client and then reviewing the police reports, the client can be advised
as to whether there is a basis for fighting and incurring the additional costs and fees which
would be involved with doing so. If there is no reasonable basis to fight, the client is so
advised and the fees and costs are commensurately less.
